Terms of Service

Effective Date: February 9, 2026

These Terms of Service ("Terms") govern your use of the Famick Home Management platform ("Service") operated by Famick ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's consent to use the Service. By using the Service, you represent and warrant that you meet these requirements.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to update it as necessary. You must notify us immediately at support@famick.com if you suspect unauthorized access to your account.

3. Free Trial

We offer a 30-day free trial with full Home-level access. No credit card is required to start. At the end of the trial period, your account will switch to read-only mode until you choose a paid plan. Your data is preserved during this transition.

4. Subscriptions & Billing

Paid subscriptions are billed monthly or annually at the rates displayed on our Pricing page. Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time from your account settings; your access continues until the end of the current billing period.

We reserve the right to change subscription prices with 30 days' advance notice. Price changes do not affect your current billing period.

5. Refunds

We offer a 24-hour refund window on the initial charge for new subscriptions. Cancelled subscriptions remain active until the end of the billing period and are not eligible for partial refunds. For full details, see our Refund Policy.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable law
  • Upload or transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use the Service to store or transmit content that infringes any third party's intellectual property rights
  • Use automated tools (bots, scrapers) to access the Service without our written permission
  • Resell, sublicense, or commercially exploit the Service without authorization

7. Intellectual Property

The Service, including its design, code, and branding, is owned by Famick and protected by intellectual property laws. You retain ownership of all content you create within the Service. By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service to you.

8. DMCA & Copyright

We respect the intellectual property rights of others. If you believe content on our platform infringes your copyright, you may submit a DMCA takedown notice to our designated agent:

  • Subject: DMCA Takedown Notice

Your notice must include: (a) identification of the copyrighted work; (b) identification of the infringing material and its location; (c) your contact information; (d) a statement of good faith belief that the use is not authorized; (e) a statement under penalty of perjury that the information is accurate; and (f) your physical or electronic signature.

Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification to the same address. Your counter-notification must include: (a) identification of the removed material; (b) a statement under penalty of perjury that the removal was a mistake; (c) your name, address, and phone number; and (d) consent to jurisdiction of your local federal court. We will restore the material within 10-14 business days unless the original complainant files a court action.

9. Email Communications

By creating an account, you consent to receive service-related emails, including account verification, security alerts, billing notifications, and important service updates. You may opt out of non-essential marketing emails at any time, but you cannot opt out of transactional service emails while your account is active.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control.

11. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMICK'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL FAMICK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.

13. Indemnification

You agree to indemnify, defend, and hold harmless Famick and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third party's rights.

14. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users. Upon termination:

  • Your access to the Service will be revoked immediately
  • You will have 30 days to export your data by contacting support@famick.com
  • After the 30-day export period, your data will be permanently deleted

You may terminate your account at any time from your account settings or by contacting us.

15. Dispute Resolution & Arbitration

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the United States and shall be conducted in English. You agree to waive any right to a jury trial or to participate in a class action.

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on our website and, where appropriate, by email. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
